Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Contractor Network website, application, and services (collectively, the "Service"), operated by Contractor Network ("Contractor Network," "we," "us," or "our"). By accessing or using the Service — including by submitting a contractor application, requesting a job, or accepting a dispatched job — you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Who we are and what the Service does
Contractor Network is a dispatch platform that connects customers who need licensed home- services work (such as HVAC, electrical, and plumbing) with independent, licensed contractors in the Austin, Texas area. We book and price jobs, verify contractor credentials, dispatch jobs to eligible contractors, facilitate payment, and coordinate communications between the parties.
Contractor Network is not a contractor and does not perform home-services work. All work is performed by independent licensed contractors who are solely responsible for the quality, safety, licensing, permitting, and legality of the services they provide.
2. Eligibility
You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business, you represent that you are authorized to bind that business to these Terms.
3. Contractor terms
These terms apply if you apply to or participate in the network as a contractor.
3.1 Licensing and insurance
You represent and warrant that you hold, and will maintain in good standing, all licenses, registrations, and permits required by the State of Texas and applicable local jurisdictions to independently perform the trade(s) you are dispatched for, and that you carry general liability insurance. You agree that only independently licensed contractors — not technicians working under another person's license — may accept and perform dispatched jobs. You will promptly notify us if your license or insurance lapses, is suspended, or is revoked.
3.2 Independent contractor relationship
You are an independent contractor. Nothing in these Terms creates an employment, agency, partnership, or joint-venture relationship between you and Contractor Network. You control the manner and means of performing the work, supply your own tools and vehicle, and are responsible for your own taxes, insurance, and business expenses. You are free to accept or decline any job and to work for others.
3.3 Accepting and performing jobs
When we dispatch a job, you may accept or decline it within the stated response window. If you accept, you agree to perform the work competently, professionally, lawfully, and in accordance with applicable codes and permitting requirements, and to complete the job as described. You are responsible for your conduct on the customer's property and for any subcontractors or helpers you bring.
3.4 Verification and background
You authorize us to verify your license, insurance, and other application information with relevant authorities and third parties. We may decline, suspend, or remove any contractor from the network at our discretion, including for failed verification, customer complaints, or violations of these Terms.
4. Customer terms
If you request a job as a customer, you agree to provide accurate information (including your service address and a description of the problem), to allow the dispatched contractor reasonable access to perform the work, and to pay the quoted price for services rendered. You acknowledge that prices quoted at booking may be estimates and that additional work identified on-site may require a separate agreement with the contractor.
For emergencies involving immediate danger — such as a gas leak, active flooding, or a sparking electrical panel — call 911 or your utility provider first. The Service is not an emergency service.
5. Payments and fees
Payments are processed by our third-party payment processor (Stripe). Customers authorize us (through Stripe) to charge the applicable amount for a job. For completed jobs, contractor payouts are made to the contractor's connected payout account, less any platform fee. Contractor Network retains a platform fee on facilitated transactions; the applicable fee or rate will be disclosed to contractors. By using the Service, you also agree to Stripe's applicable terms. We are not a bank or money transmitter and do not provide escrow services.
6. Text messages and communications
By providing your phone number and using the Service, you consent to receive calls and text (SMS) messages from us and our systems related to the Service — including job dispatch notifications, accept/decline links, status updates, and review requests — which may be sent using automated systems. Message and data rates may apply. Message frequency varies. You can opt out of non-essential texts at any time by replying STOP, or reply HELP for help. Opting out of operational messages needed to run a job may limit your ability to use the Service. See our Privacy Policy for details on how we handle your information.
7. Prohibited conduct
You agree not to:
- Provide false, misleading, or fraudulent information, including about licensing or insurance;
- Use the Service for any unlawful purpose or to perform work you are not licensed to perform;
- Circumvent the platform to avoid fees, or solicit platform customers or contractors off-platform in violation of these Terms;
- Interfere with, disrupt, probe, or attempt to gain unauthorized access to the Service or its systems;
- Harass, threaten, or discriminate against customers, contractors, or our staff.
8. Disclaimers
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted or error-free. Contractor Network does not guarantee the acts, omissions, conduct, work quality, or results of any contractor or customer, and is not a party to the services agreement between a customer and a contractor.
9. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CONTRACTOR NETWORK AND ITS OWNERS, OFFICERS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE TOTAL FEES WE RETAINED FROM TRANSACTIONS INVOLVING YOU IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
10. Indemnification
You agree to indemnify and hold harmless Contractor Network and its owners, officers, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your services or work performed, your violation of these Terms, or your violation of any law or the rights of a third party.
11. Termination
You may stop using the Service at any time. We may suspend or terminate your access to the Service at any time, with or without notice, including for violation of these Terms or to protect the Service, customers, or contractors. Sections that by their nature should survive termination (including payment obligations, disclaimers, limitation of liability, and indemnification) will survive.
12. Governing law and dispute resolution
These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Except where prohibited by law, any dispute arising out of or relating to these Terms or the Service will be resolved by binding arbitration on an individual basis, and you and Contractor Network waive the right to a jury trial and to participate in a class action. Notwithstanding the foregoing, either party may bring an individual claim in small-claims court, and either party may seek injunctive relief in a court of competent jurisdiction located in Travis County, Texas. If any part of this section is found unenforceable, the remainder will continue to apply.
13. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the "Last updated" date above and, where appropriate, provide additional notice. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
